Bernard Williams is one of the most influential figures in ethical theory, where he has set a considerable part of the current agenda. In this collection a distinguished international team of philosophers who have been stimulated by Williams's work give responses to it. The topics covered include equality; consistency; comparisons between science and ethics; integrity; moral reasons; the moral system; and moral knowledge. The questions suggested by the term "multiculturalism" range far and wide, embracing: questions of inclusion; questions of criteria; questions of self-identity; and questions of the meaning of multiculturalism. In this essay I provide a framework: that allows us to begin a discussion that might answer such questions; that illuminates why it is that such a modest aim is the most we can hope for at this time; and that provides an understanding of what we can do in a multicultural world (...) in order to illuminate what we should do. This framework will reject both the idea of toleration as found in Berlin’s conception of human choice and will speak of as maximal multiculturalism, an orientation that is found in John Milton’s idea of truth as variegated and that sees multiculturalism as a great good. These views are plagued by at least three paradoxes that are really inconsistencies. In their place I develop the idea of a mitigated multiculturalism based on fear rather than on any ideal or vision, and with this a distinction between positive and negative toleration. Negative toleration proves to parallel a classic Hobbesianism, which while an unwelcome result, paradoxically, provides further direction and reason for hope that mitigated multiculturalism can and must be surpassed. In the course of my efforts to distinguish and relate the methods and achievements of René Girard and James Alison, I have developed the hypothesis that a particular pair of theological terms might provide a helpful conceptual tool for carrying out this task—fides quae creditur and fides qua creditur. These terms were given their classic formulation within Protestant scholasticism at the beginning of the seventeenth century, where they were used to distinguish between two dimensions of Christian faith: the “object” (...) or “content” of faith , and the kind of activity that faith is or the form that it takes within the subject .My proposal, stated most briefly, is that Alison’s use of Girard’s .. The essays in this book engage the original and controversial claims from Michael Boylan's A Just Society. Each essay discusses Boylan's claims from a particular chapter and offers a critical analysis of these claims. Boylan responds to the essays in his lengthy and philosophically rich reply.

This work on the theory of education was first published in 1839. The five writers had been chosen as the winners in a competition for an essay on the 'Expediency and Means of Elevating the Profession of the Educator in Society', organised by the Central Society of Education, founded in 1837 to promote state funding of education, at a time when the 'monitor' system, whereby older children taught younger ones, was seen as an effective method. The journalist John Lalor (...) won first prize with a wide-ranging consideration of all the aspects of education, comparing the status of teachers through history and across several countries, and championing their 'sacred mission'. The runners-up were the writer John A. Heraud, the Unitarian minister Edward Higginson, the lawyer and author James Simpson, and Mrs Sarah Porter, prolific writer on education and sister of the political economist David Ricardo. (shrink)

According to the motivational thesis (MT), we are justified in performing an action if and only if we perform that action for the right reason(s). Proponents of MT disagree about how it is best interpreted—about what count as reasons of the right kind. In _Fundamentals of Criminal Law_, Andrew Simester criticises an interpretation offered by John Gardner. Here, I explore some of Simester's reasons for objecting to that interpretation, and I argue—partly on the basis of those same reasons—that Simester's (...) own interpretation of MT should be revised. I conclude with a preliminary defence of an alternative interpretation, which I call the tripartite view of justification. (shrink)

Our paper has three parts. In Part 1, we discuss John Gardner’s thesis that the non-elliptical ascription of agency to law is a necessary and irreducible part of any adequate explanation of the activities of legal officials. We consider three explananda which might conceivably necessitate this ascription, and conclude that none in fact does so. In Part 2, we discuss two other theses of Gardner’s: that it makes no sense to ascribe to law the claim that there are legal (...) obligations , and that law’s claim is the claim that there are moral obligations . We take issue with Gardner’s arguments for , and suggest that is unwarranted in the absence of an argument that law makes any claims at all. In Part 3, we briefly argue that, insofar as it issues requirements, there are certain claims that law cannot but make. We conclude that if Gardner is right that law’s claims are those of certain of its officials, it is law-making and not law-applying officials who make law’s claim. (shrink)

William James’s interest in psychical phenomena spanned his entire career as a scholar, yet is has been largely neglected. Few if any have adequately incorporated this quirky side of James into their critical studies of his scholarly contributions, not only in religious studies but also in philosophy and psychology. Psychical research was nevertheless very much part of James’s intellectual endeavors and, as this article shall argue, sheds light on an evolving, complex, and contradictory Jamesian cosmological realism. I (...) will contextual James’s widely discussed Varieties of Religious Experience, relying on his voluminous correspondence, and will explore various articulations of pragmatism, vis-à-vis James, John Dewey, Hilary Putnam, and Richard Rorty, particularly as those articulations apply to scholarship in religious studies and as they shed light on a Jamesian cosmology. I will then conclude with a discussion of psychical research as it relates to epistemology and the (scientific) study of that cosmos. (shrink)

A discussion of American pragmatism through the writings of its three major advocates: Charles S. Peirce, William James, and John Dewey. Examines how each applied pragmatism to, respectively, the theory of reality, the notion of truth, and the concept of the good.

In lieu of an abstract, here is a brief excerpt of the content:The Evolution of the Society for the Advancement of American PhilosophyJames Campbelldespite my increasingly decrepit appearance, I can lay no claim to being one of the founders of SAAP. When I joined the Society in the mid-1970s, it was already a well-functioning organization—if a much smaller one than today. After a few years of attending meetings, I began to submit papers, and I first appeared on the program at (...) our sixth annual meeting at John Carroll University in 1979. (See Fig. 1, the complete program, below.) While I was not one of the founders of SAAP, I did know them all. Presiding at the early meetings were, in the order of their presidencies, such elders as John Lachs, John J. McDermott, Darnell Rucker, James Gouinlock, Beth J. Singer, Peter H. Hare, Sandra B. Rosenthal, Thelma Z. Lavine, Joseph Betz, Charlene Haddock Seigfried, and Andrew J. Reck. Serving in the background at the same time were such patron saints as Justus Buchler, Douglas Greenlee, Abraham Edel, Max Harold Fisch, Elizabeth Flower, Edward H. Madden, David L. Miller, Frank M. Oppenheim, Evelyn Shirk, John E. Smith, and H. S. Thayer. It was a good time to be coming to American Philosophy, under the guidance of a Society that respected the fundamentals of pluralism and "fallibilism."1IThe brief discussion of the evolution of SAAP that I offer here initially emphasizes what the Society has meant to me over nearly five decades.2 As I was entering graduate school in 1974, I was drawn by the American philosophical tradition. It was, as William James writes, my "dumb conviction" that the best answers were to be found in this philosophical direction and not in the others, and that my job was to pursue these answers.3 What I found in this tradition was a refuge from both the analytic style of philosophy then dominant in America, with what I saw as its obsession with truth4 and its [End Page 1] confusion of cleverness with wisdom, and the alternatives of the various continental traditions that, although they pursued wisdom, seemed to me to rely too strongly on the mysterious or the untranslatable. My own sense of the American philosophical tradition at the time was an amalgam of Puritanism, Deism, Transcendentalism, Pragmatism in its various forms, and a large dose of Columbia Naturalism. Through further study and especially through my interactions at SAAP meetings, I became more grounded in these approaches and more open to other strands within the tradition.5 For me, cooperative interaction with others was essential to further understanding. Just as for Josiah Royce, the secret was "the community."6Among the lessons that I drew from the American philosophical tradition were the following. I knew that it was necessary to resist the human tendency to believe that what works for me will work for everyone else. As George Santayana reminds us, all philosophy is "personal."7 Thus, certain thinkers and certain thoughts will benefit from their initial plausibility to us, and other thoughts and thinkers will be initially suspect. To counter this personal prejudice, we need to partake in careful, long-term study. On a related point, Ralph Waldo Emerson urges us to seek insight from others, to accept what he calls "provocation" while not accepting their answers.8 At the same time, we live among these other individuals, marry them, teach their children, and benefit from their contributions to our social existence. In other words, American Philosophy teaches us that people are social creatures—a point which both Emerson and James were wary of, but not blind to—and that our thinking should focus on the world of shared experience. As Benjamin Franklin writes, our efforts in "Philosophy" make sense only when our pursuit of wisdom is related to human well-being.9 This point is so important that we need to wonder how our efforts were ever allowed to narrow and separate from a broad sense of human welfare to focus upon supposedly more important minutiae. While it is almost always difficult to identify firm relationships between imaginative works of literature and contemporary philosophy, it seems sure that at any particular time literature and philosophy do not float free of each other. There was a particularly solid basis for the connection in the fourteenth century, when philosophical studies were basic in advanced education and major philosopher-theologians like Walter Burley and John Wycliffe were prominent public figures. Yet significant scholarship that relates Chaucer's poetry to the philosophy (...) of the age is quite limited. A major deterrent to scholars has been a misunderstanding of the philosophical temper of England at the time, especially the influence of nominalism. While it is true that William of Ockham , who is generally thought of as the most typical and influential nominalist, taught at Oxford in the early fourteenth century, it is equally a fact that the great Scholastic realist, John Duns Scotus , also lectured at Oxford shortly after 1300, and that it was mainly realism, not nominalism, that held sway in the English schools in the late fourteenth century. The important philosophers whom we associate with the court of Edward III and with Chaucer's sphere of activity were Scholastic realists: Burley, Thomas Bradwardine, Wycliffe, Ralph Strode. Especially in light of the central position of British philosophers in European Scholastic philosophy during the century, and of Chaucer's learning and wide experience, we may assume that he was exposed to current philosophical thought through his training, personal relationships, and the general cultural climate. In all probability the realist position was dominant in what he heard and learned. (shrink)

This is my reply to five extended critical assessments of my book Law as a Leap of Faith, appearing together in a symposium issue of Law and Philosophy. The critics are Kevin Toh, Luís Duarte d’Almeida and James Edwards, Fábio Perin Shecaira, Cristina Redondo, and Matthew Smith. The topics include H.L.A. Hart’s philosophical legacy, the moral claims of law, the nature of legal reasoning, the doctrine of legal positivism, and the possibility of alienation from law.

A Return to Moral and Religious Philosophy in Early America concentrates especially on three philosophical positions that dominated early American philosophy, Puritanism and Idealism, the Enlightenment or Age of Realism, and Transcendentalism. This book focuses primarily but not exclusively on the best representatives of each. Jonathan Edwards was the most brilliant and philosophically minded of early Puritan thinkers; his thinking was colored by metaphysical idealism. Thomas Jefferson gave us the best of the Age of Reason, but other Enlightenment thinker like (...) Benjamin Franklin, Ethan Allen, and Tom Pain are considered where relevant. Ralph Waldo Emerson is presented as the best of that romantic individualism known as Transcendentalism. Briefer references are made to other early American thinkers like Samuel Johnson, John Witherspoon, Cadwallader Colden, John Adams, James Madison, Henry David Thorough, and Theodore Parker. Considerable quoted material, especially from the central figures, is included. A moral and religious interpretative framework for binding all of this together into a coherent story is provided. The purpose of this volume is to help develop, through a variety of exploratory essays, the art and science of institutional design. The authors look at a variety of good societies as artifacts, as products—at least partly—of design, and consider how such societies can be crafted. They identify themselves with the New Constitutionalism movement, which aims to develop and promote the knowledge necessary for institutional reform and institutional creation through understanding the designer's, creator's, founder's, or reformer's perspective. The Chicago school of pragmatism was one of the most controversial and prominent intellectual movements of the late 1800s and early 1900s. Spanning the ferment of academic and social thought that erupted in those turbulent times in America, the Chicago pragmatists earned widespread attention and respect for many decades. They were a central force in philosophy, contesting realism and idealism for supremacy in metaphysics, epistemology and value theory. Their functionalist views formed the Chicago school of religion, which sparked intense scrutiny (...) into the real meaning of theism, religious experience and the role of religious values in society. Their social standpoint on psychology generated the Chicago school of sociology, social psychology and symbolic interactionism that dominated the social sciences until the 1960s. Their educational philosophy was a major component of progressivism, aiming to make schools more responsive to the democratic and industrial character of the country. In economics, labour issues, civil rights and liberal politics, the Chicago school was also impossible to ignore This four-volume set focuses on the cornerstones of the thought grounding such intellectual activism: their philosophies of human nature, intelligence, values and social purpose. In addition to the infant cry being a signal for attention, it may also be a critical component of the early formation of attachments with caregivers. We consider the complex development of that attachment, which involves reciprocal interactive signaling and a host of evolutionarily conserved caregiver factors.

Reform of the federal income tax system has become a perennial item on the domestic policy agenda of the United States, although there is considerable uncertainty over specifics. Indeed the recent report of the President's Advisory Panel on Federal Tax Reform recommended not one but two divergent policy directions. In Fundamental Tax Reform, top experts in tax policy discuss a wide range of issues raised by the prospect of significant tax reform, identifying the most critical questions and considering whether the (...) answers are known, unknown--or unknowable. Conscience plays a crucial role in identifying, applying, and initiating actions chosen as right or wrong. In this paper, we pursue an answer to the question, Can bad conscience, as Nietzsche defines it, be overcome to form the ground for the creation of good conscience? Nietzsche identifies Christianity as the source of that which has to be overcome to help re-define human existence--overcoming self-destructive, bad conscience. To understand whether someone could (or even should) overcome and redefine his or her existence, (...) that is create good conscience like Nietzsche's Ubermensch, it is useful to consider the struggles of Allie Fox, the hero in Peter Weir's movie Mosquito Coast (1986). For centuries, humanists have celebrated and cherished the limitless potential of humankind and its irrepressible spirit.
